Terms and Conditions General.

Terms of use and sale of the Baziloo service.

Template to be customised before publication

This document is a starting framework, not legal advice. The fields between square brackets [ ] must be completed with your company’s actual details, and the entire text must be reviewed and approved by a legal professional before being published online, particularly as Baziloo disseminates financial information, an area governed by specific rules (disclosure of risks, promotional communications, and the distinction from investment advice depending on the relevant jurisdictions).

Article 1 — Purpose

These terms and conditions govern the use of the website [domain name] and the Baziloo service, published by [Company name], [legal form], with a share capital of [amount] €, registered with the [town] Trade and Companies Register under number [SIRET/RCS], whose registered office is situated at [full address] (hereinafter ‘Baziloo’).

Article 2 — Description of the service

Baziloo is an information platform that provides users with a selection of investment portfolios built around defined strategies. For each portfolio, Baziloo details its composition, objectives, risk level and performance history, and can notify the user (via alerts, including text messages) of changes to a portfolio to which they are subscribed.

Baziloo does not place any orders on your behalf, does not automatically copy any trades, does not manage any capital and does not provide any personalised investment advice. No performance is guaranteed. The user remains solely responsible for their investment decisions and risk management.

Article 3 — Creating an account

To access the service, you must create an account (email address and password). You agree to provide accurate information and to keep your login details confidential. Any use of the account is deemed to have been made by the account holder.

Article 4 — Free access

A free 8-day trial, with no credit card required, is available once per account. It can be cancelled at any time free of charge and without any formalities. At the end of this period, access to the relevant portfolios will be suspended unless a paid subscription is taken out.

Article 5 — Subscriptions and charges

The current prices are displayed on the ‘Pricing’ page at the time of subscription. Each subscription covers one or more portfolios for a duration chosen by the user at the time of purchase, either 30 days or 12 months, and is renewable manually (there is no automatic renewal without action by the user: upon expiry, access ends automatically and no further payments are triggered). A ‘All Portfolios’ bundle is available at a preferential rate.

Article 6 — Payment

Payment can be made by credit/debit card (Stripe), PayPal or cryptocurrency (via a cryptocurrency payment provider or to a portfolio address provided, depending on the current settings). The account is activated as soon as payment is confirmed by the relevant payment provider.

Article 7 — Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to digital content and services that have been fully performed, where performance began with the consumer’s prior consent and the consumer has expressly waived their right of withdrawal. By taking out a paid subscription, the user acknowledges that the service commences immediately and waives their right of withdrawal for the period already used.

Article 8 — Termination

Users may stop using the service at any time; subscriptions are not automatically renewed. Baziloo reserves the right to suspend or terminate an account in the event of fraudulent use or a breach of these terms and conditions.

Article 9 — Risk warning

All investments involve a risk of capital loss. The value of an investment may rise or fall, and past performance is not indicative of future results. The portfolios shown are for information purposes only and do not constitute personalised advice. The user is solely responsible for assessing their own circumstances and risk tolerance before making any investment decision.

Article 10 — Liability

Baziloo takes all reasonable steps to ensure the availability of the service and the accuracy of the information published, without guaranteeing any specific results or completeness. Baziloo shall not be held liable for any financial losses resulting from the user’s investment decisions, any error or delay in the data displayed, any interruption to the service or any event of force majeure.

Article 11 — Intellectual property

All elements of the website (text, trademarks, logos, technology) are the exclusive property of Baziloo or its partners and may not be reproduced without prior authorisation.

Article 12 — Personal data

The processing of personal data is described in our privacy policy. [Insert here, or in a separate document, a comprehensive privacy policy compliant with the GDPR: purposes of processing, retention periods, rights of access, rectification and erasure, and contact details of the Data Protection Officer where applicable.]

Article 13 — Applicable law

These terms and conditions are governed by [French / to be specified] law. Any dispute shall fall within the jurisdiction of the courts of [town], subject to any mandatory provisions applicable to consumers.
